Executive Order for Travel/Returning to the US

Pay close attention to Section 5, is there a possible mandatory quarantine coming? Not sure if this is just "recommended" or "mandatory".

I don’t read it either way. They basically took Trump’s executive order and replaced it with Biden’s name. Here is the problem I see with both orders is the repeating theme “consistent with applicable law”. There are no laws about wearing masks or quarantined people. No that’s not to say they aren’t coming, but that is another conversation, but read the last two paragraphs “b””c”, once again my argument. I personally don’t see it coming, and how would you enforce it, not enough personnel.

Back during the summer when up state gov’s were imposing all those crazy travel bands from state to state with quarantining when you returned home. Here at our beach, you couldn’t go 75yrds without seeing an up state license plate, every single week, it was crazy. Do you think when they went home that they checked in with there local gov and informed them of where they and been and started the quarantine time, I don’t think so. So once again, pointing out the obvious from my observations, not enough personal to enforce theses orders.

Also, this order is inconsistent with the CDC order from earlier this month. The CDC order allows a person to travel with "proof of a recent positive viral test and a letter from your healthcare provider or a public health official stating that you were cleared to travel." Didn't see that in this EO.

I'm travelling next month, and I have exactly this. Positive test (from December) and a note from my physician. Wondering if this will be sufficient to return home.

Fairly certain that the mandatory quarantine only applies if someone does not have proof of a negative COVID test. All that should be needed is the negative test result obtained within three days of your return to the states and all should be good. Hopefully, this will be amended in a few months when enough of the population is vaccinated.

How do you read this, Scubaman? I've been searching various government, CDC, and travel websites and I can't find anything that requires a mandatory 14-day quarantine for U.S. citizens who return to the states, unless they knowingly have been exposed to someone with COVID-19. The President's executive order from 1/21/21 gives the new Secretary of Health and Human Services and the Secretary of Transportation 14 days to assess the order and determine if further steps are necessary. It may hinge on where someone is traveling from (such as a Level '4' COVID country). But, a negative 'viral' test within the 72 hour window of their return looks like a lock. The executive order reverts back to the enhanced CDC guidelines on January 12th and from that I could not find any mandatory quarantine requirements. Of course, with all of this going on personally I would wait before I travel internationally.

I do not believe it mandates quarantine upon return from international destinations.

Read section 5 closely. If not mandated now, it may be in the works once the CDC gets more involved.

Totally depends on the State you are returning to and many states do require a negative test and quarantine until that result is back...State mandated not USA mandated....yet

It all depends on the authority of an executive order, which is really very limited in establishing requirements.

I just heard Biden (5:00 on Jan 26, 2021) say that a quarantine is required at his Covid briefing. The executive order mandates a negative test and following CDC guidelines when returning from a high-risk country. That is almost all countries. CDC guidance say 7 days with a negative test, and 14 day of quarantine if you do not get tested.

Can this be enforced? Maybe by state law or possible Federal law. I doubt by Executive Order.

I am not a lawyer, but I have had develop many regulations to implement a lot of Executive Orders over my years of Federal Government service.

If they are going to do that for most countries then how can they ignore travel in the US from states that are MUCH worse.

We have the states with their own guidance conflicting with the mandates from the Feds, Guess you just have to pick one. We got tested (negative) the day of our return and that is that as far as I'm concerned. Back to normal mask and distancing etc.

And now Biden and Fauci say wear TWO masks at a time. Waiting for the distance mandate to change too.

Maybe Fauci can get back part of the 7 mil he donated to that Wuhan Lab for testing when Obama shut down the US doing it. Read about it in Newsweek. Then he can buy everyone a N95 mask.
