Probably just like many of the shacks on Kim Sha and operations at other beaches. Sometimes you get caught and sometimes you can operate a long time. You keep going until you are forced to stop and and then you either deal with it or you walk away. Although, as big as this project was, it would be surprising no permits at all were applied for. But, then again, it is St. Maarten.

This is not unusual... On average 130 stop and removal orders are given per year. The permits issued bring in a revenue of 2,000,000 NAF per year. It is very political. The Nature Foundation protects the beaches but also receives money from the Gov. There are always exemptions unless it is being targeted for other reasons.

OK, that's bizarre, as much money as was supposedly going into that thing? And there was a story in the Daily Herald about the project in something like May of last year. If they didn't have a permit, why did Nature Foundation, or the government, for that matter, let the thing get this far along?? Handshake deal with a politician no longer in favor??

Right. That's what I said. I was told at one point that land belonged to a sitting Member of Parliament, so that would kind of make sense, the way things happen on SXM. But then I also heard that was NOT true, so things that you 'hear' are often not what they seem! crazy

The architect is no stranger to high end projects and I would think would have been involved in the permit process.
This is an enviromental issue which needs additional permits when it effects the surrounding area. I read the article but I think there needs to be a fact check here. I will bet there was a permit but it could have been revoked for some reason.

The building permit was for one floor and it seems a VIP lounge was added making it two stories.
Just my guess untill further info comes to light.

Grand opening was SUPPOSED to be February 17, you mean. That makes a bit more sense, if they exceeded the building permit, and that's what the issue is.

For something that has been going on for a year how could the Nature Foundation just discovered this as reported.
"Last week we were alerted that there was possible illegal construction happening at the area of Simpson Bay Beach popularly known as Kim Sha at the location of the construction site of Roxxy Beach Bar", says the St Maarten Nature Foundation
Key word is "possible" illegal construction.

"ROXXY BEACH has a valid building permit for its development.

In recent media posts the impression was created that it did not. This is not correct and ROXXY BEACH continues to finalize its restaurant and beach bar



An issue came up with a small semi-permanent structure in front of the building that would have been used as a service station.

Like other places where pop up service stations are built; Karakter, Mary’s Boon and the entire strip of bars on the parking lot next door, ROXXY BEACH was informed that such was allowed. Once informed that such was not the case, ROXXY BEACH, stopped said endeavors.



ROXXY BEACH is built on various principles. One of them being environmental conscious. It collected over 1000 beer bottles and soda cans out of the sand in front of the property at a depth at 5 feet using a special built sand filtering system. It used special non-corrosive sheet pilings to avoid any rust entering the sand and the environment and it spend considerable amounts for the restoration and replanting of (palm)trees on and in front of its property.

ROXXY BEACH aims to be as CO2 neutral as possible and uses the best energy saving options available.



ROXXY BEACH will be open in March 2019 for its Guests”

I really doubt that Roxy would post up such verifiable information unless it were true. With the SXM governments track record I'm believing the developer......... not that it matters.

I agree! It is their Facebook page and not someone commenting. I think the news was fake and they could have investigated it further before misleading people about Roxxy Beach Bar.

I believe the problem was the same as Karakter had, in that they had permits for the structure but then theystarxed to add on a serving station "On the beach" like the platform at Karakter.
