Our boat got hit by another boat and damaged - 01/09/2019 09:51 PM

I don't want to get into too many specifics. But our boat was hit by another boat recently. The Captain of the other boat admitted to it and knows they did damage, but now doesn't want to do the right thing and take care of it. We're hoping we can still get it worked out, but I'm wondering what our options might be? Anyone else run into something like this before?

Where did it happen? My boat was hit in International waters and I had to "eat it" so to speak.

It happened in the BVI at an anchorage.

Was it a charter or his own boat?

Really need a lot more info to help. If it was a charterboat that hit you the charter company might help.

It was a charter boat. Private though, not with a charter company. So no help from a charter company. Haven't dealt with the owner yet. Our charter company is dealing with it now trying to get it worked out.

Were there any witnesses, webcam footage, security cameras? Was the captain a hired hand or the guy who chartered the boat? Were they insured?

Matt, for now I'd leave it up to your charter company and their insurer to deal with the other boat's owner & insurer, unless your charter company is wanting money from you now. If the other boat is licensed as a charter boat in the BVI, then they're insured. If they're not, I would think they'd want to settle this quickly and quietly to avoid any scrutiny from government.

Captain admitted it, as I understand even signed something. There's also a signed witness statement and it was reported to the authorities. Our charter co has done everything correct. I'm sure they have insurance, but like us, I'm sure the insurance deductible is above what the cost of repairs are. It's not an astronomical amount - about what a one week charter costs. At the same time though, its only 10% of what the boat that hit us gets for a week long charter.

We are letting our charter company handle it, just thought I'd see what other feedback ideas or past experiences anyone may have had.

Just curious, how does a crewed charter boat hit another boat at anchor? I have been hit by a bareboater once and had my dinghy ran over by another bareboater but usually the crewed boats manage to not hit anyone.

If it is US documented find out who the actual owner is. Approach them first. The crew may not have even told them. If that fails put a lien on the boat.

Something happened with the steering or something like that - seems like a mechanical issue that caused it.

Thanks, We're trying to do that - it isn't a US flagged boat. I believe it is French.
