What strikes me as really weird about this ruling is that the evidence linking Kildare and Endless Vacation was never presented. From what I understand of St. Maarten court proceedings this was an injunction case, which is a sort of a mini hearing and limited in scope. This still leaves plenty of room for further evidence in what is referred to as a main case. It still strikes me as odd that the lawyers for the Association did not even submit this evidence for the judge to see.
