As everyone on this post has indicated the conditions at Sapphire continue to deteriorate while the owners send out requests for maintenance fees which are then not used for maintenance. In our original contract under "Obligations and rights of the Lessor" it states that "The Lessor is hereby obliged to maintain the entire living area(s) of The Sapphire Beach Club in good condition and appropriately furnished." I would think that based on the deplorable condition the resort has been allowed to reach that Sapphire would be considered in breach of contract and all timeshare owners would be justified in not paying their maintenance fees until the situation improves. Does anyone know if this would be legally binding?

I don't think it would do any good, if you want to stay there, you have to pay your maintenance fees. If you don't pay the fees, they have the right to terminate your contract. You can show them the obligations, they can say they've repaired a few things, replaced a few things, but definitely not keeping it up to par. The owner does not care, he would like to sell the place and there have been offers, or so I've been told, but nothing that panned out. The people that work there would love it to be sold and brought back to something to behold, but if and until that happens, you are stuck with it's limitations.

Not paying the fees would cause more things not to be fixed. As more owners walk away or are delinquent in their fees there is less money to fix and maintain the resort. Catch 22.

Sapphire Beach Club has reached the point of no return. Some owners are simply giving up because maintenance fees exceed a rental fee.

The owners are not accepting offers, meanwhile the place goes down the drain and no one will offer more, only less and less.

On rental market the Sapphire has the worst reputation (probably unjustified).

The Sapphire is timeshare gone bad in a nutshell.

I will never invest in timeshare, maintenance fees and maintenance management is enough of a headache when buying a condo.

I am so sorry to hear that. We stayed at the Sapphire in 2012 in the penthouse. It was absolutely one of our best experiences! The best was beautiful, the view spectacular and the staff were more than accomodating. We had own private pool, hot tub on master bedroom balcony,,,just lovely. We did an RCI exchange into the Saphire in January. I always read posts about the Saphire as I was keeping my fingers crossed that someone eventually would do something to stop the downward spiral.....too bad
